Detailed conditions of the performance of the Act on Fishery in the localities of ČRS for the year 2006 were discussed and approved by the Board of ČRS on 30 June 2005.
Outline of the most important provisions of the Act No. 99/2004 Coll. and Ordinance No. 197/2004 Coll.
I. Way of measuring of the length of fish and the minimum allowed length of selected species in the fishing locality
Article 11 Ordinance No. 197/2004 Coll.
(1) Length of fish is measured from the front most point of the head to the furthermost end of the fish tail
(2) The shortest minimum lengths of selected species in the non-salmonid fishing localities are following:
a) asp (Aspius aspius) | 40 cm, |

(3) The shortest minimum lengths of selected species in salmonid water areas are:
a) huch (Danubian) (Hucho hucho) 65 cm,
b) orfe (Leuciscus idus) 25 cm
c) sterlet (Acipenser ruthenus) 30 cm
d) carp (Cyprinus carpio) 35 cm
e) tench (Tinca tinca) 20 cm
f) grayling (Thymallus thymallus) 30 cm
g) nase (Chondrostoma nasus) 30 cm

j) rainbow trout (Oncorhynchus mykiss) 25 cm

II. Time of fishing in the calendar year in the fishing locality
Article 12 Ordinance No. 197/2004 Coll.
(1) Time of fishing in salmonid waters is:
a) in months of November and December from 7 a.m. to 5 p.m.,
b) in months of January and February from 7 a.m. to 5 p.m.,
c) in month of March from 6 a.m. to 6 p.m.,
d) in month of April from 5 a.m. to 7 p.m., (from 6 a.m. to 8 p.m. Daylight Savings Time)
e) in month of May from 5 a.m. to 8 p.m., (from 6 a.m. to 9 p.m. Daylight Savings Time)
f) in months of June and July from 4 a.m. to 9 p.m., (from 5 a.m. to 10 p.m. Daylight Savings Time)
g) in month of August from 5 a.m. to 9 p.m., (from 6 a.m. to 10 p.m. Daylight Savings Time)
h) in months of September and October from 6 a.m. to 6 p.m., (from 7 a.m. to 7 p.m. Daylight Savings Time)
(2) Time of fishing in non-salmonid waters is:
a) in months of November, December, January and February from 7 a.m. to 6 p.m.,
b) in months of March, April, September and October from 5 a.m. to 9 p.m.,
(from 6 a.m. to 10 p.m. Daylight Savings Time)
c) in months of May, June, July and August from 3 a.m. to 11 p.m.,
(from 4 a.m. to 12 p.m. Daylight Savings Time)
(3) Data in sections 1 and 2 are presented in CET (Central European Time)
III. Periods of fish protection in fishing localities
Article 13 Ordinance No. 197/2004 Coll.
(1) From 1 September to 15 April the following fish spe-cies are protected in the fishing localities:
a) brown trout (Salmo trutta),b) salmon (Atlantic) (Salmo salar).
(2) From 16 March to 15 June are
a) in the fishing locality protected:
1. nase (Chondrostoma nasus),
2.barbel (Barbus barbus),
3.eastern barbel (Barbus meridionalis-petényi),
4.vimba (Vimba vimba),
5.sturgeon, beluga (family Acipenser, family Huso),
b) in non-salmonid fishing localities are protected the fol-lowing species:
1.orfe (Leuciscus idus),
2.chub (Leuciscus cephalus).
(3) From 1 January to 15 June are
a) in the fishing locality protected:
1.asp (Aspius aspius),
2.pike-perch (Stizostedion lucioperca),
b) in non-salmonid fishing localities also protected the following species:
1.catfish (Silurus glanis),
2.pike (Esox lucius).
(4) From 1 December to 15 June grayling (Thymallus thymallus) is protected in the fishing localities.
(5) From1 January to 30 September huch (Danubian) (Hucho hucho) is protected in the fishing localities.
(6) From 1 September to 30 November eel (Anguilla anguilla) is protected in the fishing localities.
(7) From 1 January to 15 March burbot (Lota lota) is protected in the fishing localities.
IV. Allowed ways of fishing, allowed technical means of fishing and way of their use in the fishing locality
Article 14 Ordinance No. 197/2004 Coll.
(1) Allowed way of fishing in the fishing locality is fishing with a rod, and it is fishing with fixed possition of bait, fishing with free floating possition of bait, spinning, fishing with an artificial fly, fly fishing, stake net fishing or other ways of fishing stated by the relevant fishing authority (Article 13 sect. 1 of the Act).
(2) When fishing with a rod, persons fishing next to each other must keep safety distance at fishing with fixed possi-tion of bait, at stake net fishing or fishing with free floating possition of bait at least 3 m, unless they agree a shorter distance; when spinning, dry fly or fly-fishing at least 20 m, unless they agree a shorter distance. Places for fishing must not be reserved. When boat fishing moving and stopping the boat must be done in the way, in order not to disturb the other people fishing from the bank.
(4) Fishing with a rod in free floating possition or fixed possition of bait or stake net fishing may be done under the condition that a fishing person with the rod is present in the way to be able to handle with a rod without any delay. Automatic hooking device must not be used.
(5) Use of boats when fishing is specified by special legal directives.
Article 15 Ordinance No. 197/2004 Coll.
(1) Caught fish in the fishing locality, which
a) do not reach the shortest minimum lengths
b) were caught in the protection period or
c) are protected according to the special legal directives,
must be gently released into water, where they were caught.
(2) If a fisherman catches a fish, which has been marked for scientific purposes, he/she will determine the species, measure its length and weigh its weight. If this is a fish presented in the Article 15 section 1, he/she will record its shape, colour and possibly even the mark number and will report this catch together with recorded data to the user of this area; in the report he/she will present time and place of catch. If the fish is not presented in the Article 15, section 1, he/she will record all data about the length and weight of the fish into his record card; found data he/she will report to the fishery area user, in the report he/she will state time and place of catch and will add the mark.
Article 16 Ordinance No. 197/2004 Coll.
(1) non-salmonid waters the allowed ways of fishing are:
a) fishing with fixed or free floating possition of bait
b) spinning or deep spinning between 16 June and 31 December
c) fishing with an artificial fly or fly fishing,
d) stake net fishing between 16 June and 31 December or
e) fishing of predatory species in the period between 16 June and 31 December.
(2) When fishing in the way presented in section, 1 letter. a) maximum of 2 rods with maximum of two tips with single hooks or one tip with double or triple hook may be used. You may even use a bait of vegetal or animal origin un-threatening water quality. When fishing with natural bait more-hook-systems with maximum of three hooks (from single to triple hooks) may be used. As a live fish bait neither salmonid fish, grayling nor protected species and fish, which do not reach the shortest minimum length, may be used.
(3) When fishing in the way presented in section 1, letter b) one rod with a single tip may be used only. Spinner, artificial or natural bait may be used as a bait. Spinning baits may have three hooks at maximum (double hooks, triple hooks) according to its construction.
(4) When fishing as in section 1, letter c) one rod with maxi-mum of three tips, and on each tip only one single hook or double hook according to the used bait, may be used only. An artificial fly live or dead insect may be used.
(5) When fishing in non-salmonid waters a fisherman may keep maximum of 7 kgs of all species even if he/she fish-es in more fishing localities in one day. In this catch there may be maximum of two pieces of carp, pike, pike-perch, asp, catfish or their combination. If he/she intends to keep
the fish and the weight of the catch exceeds 7 kg with the first caught fish, fishing that day must be finished.
(6) If salmonid fish and graylings occur in the non-salmonid fishing locality, the fishing person may keep, next to the catch presented in section 5, only 3 pcs of salmonid species and grayling or their combination, unless the total weight of daily catch will not exceed 7 kgs. Common whitefish and peled are not considered in the amount of catches for salmonid species.
(7) A fisherman must write down taken fish into the record card in an uneraseable way, where he/she must record the date, fishing locality number, species, its length and weight. This record of species registered in sections 5 and 6 must be done immediately by the fisherman after its capture. Other species must be registered during the break or after the end of fishing, before leaving the fishing locality.
Article 17 Ordinance No. 197/2004 Coll.
(1) In salmonid waters the allowed way of fishing of salmonid species and grayling is
a) spinning from 16 April to 31 August,
b) fishing with an artificial fly from 16 April to 30 November,
c) spinning for huch from 1 October to 31 December with a special licence issued by the user of fishing locality.
(2) If there are other species in salmonid waters except salmonid species and grayling, the allowed way of fishing is
a) at non-predatory species, fishing with fixed or free floating possition of bait only with baits of vegetal origin,
b) at predatory species
1.spinning from 16 April to 31 August,
2. fishing with an artificial fly from 16 April to 30 November,
3. fixed or free floating possition of bait.
(3) When fishing as in section 1, letter a) one rod, held in the fisherman´s hand, with one tip with a single hook, double hook or triple hook according to used spinning bait, may be used only.
(4) If pike, chub, perch, catfish, asp or pike-perch occur in salmonid water, their fishing may be done in the ways and with baits allowed for fishing salmonid or non-predatory species. These species must not be released back.
(5) When fishing with fixed and free floating possition of bait maximum of two rods, when each has maximum of two tips with single hooks or one tip with a double hook or triple hook, may be used. Baits of vegetal origin only may be used.
(6) When fishing spinning one rod only may be used. It is al-lowed to use spinning baits with maximum of two hooks, double hooks or triple hooks used according to the used bait.
(7) When fishing with an artificial fly, one rod with maximum of three tips, but on each tip with one single hook only, may be used only. As a bait you may use single hook flies only.
(8) A person fishing in salmonid waters may keep in one day, even fishing in more fishing localities, maximum of three pieces of salmonid fish and grayling or their combination. By keeping the allowed amount of presented fish the fishing day ends. Common whitefish and peled are not considered for catches of salmonid species.
(9) A fishing person may keep maximum of 7 kg of non-predatory species in one day without respect to number of fishing localities being fished that day. If the fishing person keeps a fish, whose total weight exceeded 7 kgs, fishing finishes that day. In the daily catch there may be two carps only.
(10) The fishing person records the caught fish into the record card in an uneraseable way, where the date, number of fishing locality, species, its length and weight are recorded. Kept fish presented in sections 8 and 9 are recorded immediately after their capture by the fishing person. Other species are recorded after the end or break of the fishing before leaving water.
V. When fishing in the fishing locality it is prohibited
Article 13 section 2 and 3 Act No. 99/2004 Coll.
(2) When fishing in the fishing locality and in the fishery it is forbidden
a) to use explosives, poisonous or narcotic material,
b) to use spikes of whichever kind, catchers, rods without the line, forks, as well as shooting fish, beating fish, fishing with lines only, into hands and into loops,
c) to use electricity, to fish under ice.
(3) In the fishing localities it is forbidden to fish
a) selected species in the period of their protection for reason of their protection and reproduction,
b) selected species, which have not reached the shortest minimum length yet, for reason of protection of these species,
c) off the allowed time for fishing in the calendar year for reason of fish stock protection,
d) with use of any fixed device for fishing or nets, which are not further than 50 m from each other or prevent from swimming of fish upstream or downstream,
e) from inhabited boats, from boats of public transport and from special floating devices used for transportation of loads,
f) in penstocks
g) near the dams at least 100 meters from the dam,
h) from the road and rail bridges,
i) to fish in locations used by fish as shelters due to low water level, harmful water pollution or in areas where fish gather to winter or spawn, fish the fish fry, unless these restrictions are done by the supervisor with regards to protection, or relocation of fish into other waters,
j) fish into sluices,
k) in the fish transfer or in the distance of 50 m above and below it.
VI. Fishing
Article 13 section 1, 7 and 9 Act No. 99/2004 Col.
(1) Fishing of fish and water organisms may be done in the fishing locality by fishing with a rod or other means of fishing, which are stated by the relevant fishing authority; in the fishing locality the single licenced person may practise fishing with maximum of 2 rods.
(7) When fishing in the fishing locality, the fishing person is required to have a fishing permit, fishing licence with, unless he/she is a user of the fishing locality, or a docu-ment of given exception according to section 4 or 5 Article 13 Act No. 99/2004 Coll. and to present this to the fishing inspection, fishery manager or his/her deputy or people relevant to fishery authority or the authority of Police of the Czech Republlic for request.
(9) A fishing personis obligated to mark date of fishing, fishing locality, number, species and weight of caught fish into the record card.
VII. Power of fishing inspection
Article 16 a 17 Act No. 99/2004 Coll.
Article 16
In the fishing locality the fishing inspection is entitled to
a) check
1.persons fishing fish or water organisms, whether they are authorized and whether they do it well and in the way, which this Act makes possible,
2.fishing tackle, contents of fishing boat, tanks or other equipment used for keeping the fish and catches from the point of view of Act on Fishery to fishing persons,
3.persons fishing with the help of electricity, whether they are holders of a special licence, as well as they keep a certificate prooving their eligibility for work with electric device for fishing and certificate of electrical device used for fishing,
4.use of weirs, flood gates, sluices, outfalls and other de-vices from the point of view of keeping legal directives and provisions for protection of performance of Act on Fishery,
5.way and range of use of waters and their quality;
b) require
1.an ID card, presenting fishing licence and permit from a person fishing fish and water organisms,
2.from a person reasonably suspected from committing an offence or a crime very near the fishing locality
3.presenting the fishing licence or permit or other documents allowing the person fishing or a document about obtaining fish or a water organism,
4.cooperation or help of the Police of the Czech Republic or municipal police if the fishing inspection cannot arrange all with its own power and means;
c) catch
1.fishing permit from a person, which committed an offence or a crime against duties and responsibilities given by this Act and fishing inspection will deliver the fishing licence within 5 week days to the issuing authority of this permit,
2.a catch, fishing tackle or an instrument to a person, which committed a crime, which the person is reason-ably suspected from;
d) enter the land, constructions, weirs, fish transfers and other devices in connection with performance of function of the fishing inspection, in necessary extent, and in case of necessity use the other existing access ways;
e) give and collect a penalty in a ticket procedure for committing an offence or a crime according to this Act and according to the Act on Offence.
Article 17
(1) Fishing inspection when performing its function is obligated to
a) wear a professional badge on a visible place,
b) legitimize with an ID card of a fishing inspection, c) check and supervise keeping duties stated by this Act, d) find out the sources and causes of water pollution in the fishing locality,
c)announce without any delay found faults and damages according to its character to announce to the user of a fishing locality, relevant local authority of municipal-ity with the extended power, which had set it up, or possibly to the authority relevant for environmental protection or the Police of the Czech Republic.
VIII. Land access
Article 11 section 8 Act No. 99/2004 Coll.
User of the fishing locality, fishery manager or his deputy, fishing permit holder and fishing inspection may, when per-forming Act on Fishery, enter the bank lands, unless the enter is prohibited for reason of public interest; however they are obligated to repay the damage they cause.
Detailed conditions for performance of Acton Fishery in the fishing localities of CFU
Article 13 section 9 Act No. 99/2004 Coll.
I. Period of protection of some species
The following species are protected all year round:
1.atlantic salmon (Salmo salar),
2.all year round are protected according to Ordinance No. 395/92 Coll. (it is the list of selected species only):
a) Petromyzontes (lampreys) and fishes (Osteich-thyes): common minnow, Kessler‘s gudgeon, spirlin, Danubian bream (Abramis sapa), Danube roach (Rutilus pigus), chehon (Pelecus cultratus), spined loach (Cobitis taenia), goldside loach (Sabanejewia balcanica), weather loach (Misgur-nus fossilis), yellow pope (Gymnocephalus schra-etser), Danube streber (Zingel streber), zingel (Zingel zingel), bullhead (Cottus gobio), siberian sculpin (Cottus poecilopus), European brook lamprey (Lampetra planeri) and Ukrainian brook lamprey (Eudontomyzon mariae),
b) invertebrates: stone crayfish, crayfish (Astacus fluviatilis), Galician crayfish, Pearl oyster Mussel, painter‘s mussel and Swan mussel,
c) amphibians.
II. Fishing in the salmonid water areas
Fishing of all fish species is prohibited in salmonid waters from 1 January to 15 April and from 1 to 31 December except the fishing of huch with the special fishing permit issued by the user of the fishing locality.
While spinning the artificial spinning baits are permitted only.
To fish salmonid species and grayling may be done by a person practising the fishing max. 3 days a week. Before the start of fishing of salmonid species and grayling the fisherman must write into the fishing permit the date and No. of the fishing ground in an uneraseable way. The date will be circled. When the person fishes other species than salmonid ones and grayling, all caught salmonid species and grayling must be released back. In the salmonid fishing locality the fishing person may take, even if he/she fishes in more than one fishing ground, maximum of three pieces of salmonid species incl. grayling or their combination.
III. Boat fishing
Boat fishing is prohibited. Localities or their parts, where boat fishing is permitted, have been assigned by the user of this fishing locallity.
A person fishing from the boat must not use any other rod for fishing outside the boat.
IV. Setting of bait by boat
It is prohibited to set the bait by boat. Exceptions may be granted by the representatives of designated fishing ground. It is not decisive, which means of float he/she uses or if the bait or lure is set by swimming.
V. Deep-water spinning
Deep-water spinning is prohibited. This may be permitted by the user of the fishing locality.
VI. Fishing of the live fish and fishing of the fish baits
Fishing with the fish as a bait is permitted between 16 June and 31 December only.
While fishing with the live fish baits into the drop net, the fishing person must not fish with any other rods.
VII. A fisherman is obligated
a) Keep the tweezers for the hook release and measure for the length of the fish,
b) to write down into part II of the fishing permit (Register of presence and catches) before the start of fishing on the non-salmonid and salmonid fishing ground the date and No.of the fishing ground.
VIII. Handling with the catch
When taking a fish out of water the fishing person is obligated to handle with the fish carefully. If it is not possible to lift a fish above water by lifting the rod, it is necessary to use a landing net. Fish, which are released back into water, must be taken the hook out of mouth without delay and in water, if possible. If a hook is deep in the throat of a fish, it is necessary to cut the hook off. As a rough violation of this rule will be considered lifting the fish up onto the bank and insensitive release.
If the fishing person kills the caught fish, cleans and removes entrails, these must not be thrown back into water or left on the place.
IX. Keeping the catches
If the fishing person keeps the catch alive, he/she is obligated to have his/her own net with supporting circles or such a device, which allows at least a minimum movement (containers, constructions covered with net etc.). It is prohibited to fix a fish by threadding the rope through the gill or other insensitive way or to leave live fish to die. A fish placed in the net etc. is considered for the kept fish. It is prohibited to use mutual nets etc.
If the fish are kept in the containers for longer time, these must be marked with the label with the name of the owner and his/her address.
X. Conduct when fishing
Fishing person is obligated to keep the place clean. It is forbidden to leave waste on the bank or to throw them into water. As an especially rough misconduct will be is considered if the fishing person handles with the glass waste by throwing it into water. After arrival to the place of fishing the fishing per-son will make the inspection of the place, where he/she wants to fish from. If this place has been polluted, cleaning will be made before the start of fishing.

Techniques of rod fishing, permitted technical means of fishing and other ways of fishing in the fishing locality
Techniques of fishing
Fishing is made with rod, line or nylon, fish hook or bait:
(1) Fixed position of bait
It is fishing with 1 or 2 rods with a bait at the bottom. The rod may be placed in different types of stands or hold it in hand. Move of bait is not actively influenced by the fisherman. Fishing with the fixed bait may be combined with a free float-ing possition of bait.
(2) Free floating possition of bait
It is fishing with 1 or 2 rods with a bait, which may be in move (taken by the stream of water) or even in calm (still wa-ters) adjusted in free heigth of water column. Adjustment of bait is ensured mainly by the float. Movement of the bait may be actively influenced by the fisherman. Rods may be placed in differenet types of stands or held in hands. Fishing in this way may be combined with fixed possition of bait.
(3) Spinning
It is a fishing with one rod only, when the rod is held in the hand, another rod must not be set. Bait is actively driven through the water environment. This method may be used for predatory species and salmonid species mainly. Spinning describes even fishing with an artificial fly or fly fishing in case of use of spinning bait or a fly equipped with a device such as rotating metal, little propeller, which increases fish attraction while moving.
(4) Deep-water spinning
It is a fishing with one rod only, where there is one bait only, another rod must not be set up. Deep spinning char-acterises pulling the bait behind the moving fishing boat in different depth of water. The bait may be moved maximum in the distance of 20 m behind the moving boat and must not endanger the publicity.
(5) Fishing with an artificial fly
It is a fishing with one rod only and with an artificial fly casted with a flyfishing line, and another rod must not be set. Fly fishing line may be substituted with nylon, when floating is ensured by the ball or other float, possibly other weight. When fishing with an artificial fly you may use maximum of three tips and on each of them one single hook only. If the bait is equipped with a double or triple hook, you may use one tip only. Under „artificial fly“we understand baits imitating insect or other organisms. Bait must not be equipped with devices such as rotating metal, little propeller which increase attrac-tion for fish. These devices are considered for spins.
(6) Fly fishing
It is fishing with one rod only with a fly fishing line, another rod must not be set. Fly fishing line may be substituted with nylon, when the floating function ensures the ball float or another weight. When fly fishing you may use maximum of two tips and on each tip you may use one single hook only. If the baits are equipped with a double or triple hook, you may use one tip only. As a bait you may use live or dead insect as well.
The bait must not be equipped with a device such as rotating metal, little propeller, which increases the attraction for fish. These devices are then considered for spins. Fly fishing you may use in non-salmonid waters only.
(7) Fishing predatory species
It is the way of fishing predatory species (pike, pike-perch, catfish, asp) mainly, e.g. spinning, deep-water spinning and fishing with baits abundantly determined to their fishing e.g. spinning and baits used for fishing with a spin, multihooks, wad of worms on bigger hooks, small fish, mouse, mole.
(8) Boat fishing
It is a fishing performed from a fishing boat or from a floating inflatable fishing tool determined to fishing. A fish-ing person performing the fishing must respect all navigatory regulations and regulations modifying operation of a floating device.
(9) Catching a live bait into stake nets
It is a fishing of live fish with a horizontal net of the maximum area of 1 m2.
(10) Allowed means of fishing
Attractors, fishing boats, floating inflatable fishing tools determined to fishing, echo sounder, landing net, rod, stake net, net with supporting circles, gauge, rod forks, floats, weight.
(11) Buoy fishing (it is not a part of Supplement No. 7 Ordinance 197/2004 Coll.)
It is fishing of predatory species with approved floating device (buoys, floats etc.), (buoy as follows). Buoys, which are not a solid part of a rod, are prohibited. When fishing predatory species buoys of maximum dimensions and supporting buoy with dimensions do not exceed 6 x 6 x 30 cm may be used, or two buoys of maximum dimensions 10 x 10 x 10 cm, which are connected with a connector in maximum distance up to 150 cm. Connection of buoy and supporting buoy must ensure disconnection after strike and the supporting buoy would not be a part of a rod. As a buoy must not be used untreated polystyrene and untreated plastics (incl. PET bottles). System od buoy may be anchored either between bait and rod or even behind bait, but always it must be a part of a rod. Whichever device (buoys, floats etc.) determined for fishing of predators, must be taken from water after the end of fishing. The purpose of a buoy is to keep the bait in selected depth. Buoy must be visible from the place of a fishing person and with its dimensions it must not a help for playing with a hooked fish. It is valid even for this way of fishing that a fishing person must be present near the rods in order to be able to handle with them immediately. System of buoy must not be supplied with another system of hooks. It is forbidden to have casted rods in water without a bait.
As a buoy it is considered every signal device (float), used for fishing of predators, or a system of two and more buoys connected (with a stick, spring, wire, nylon etc.), which target is to keep the bait under water in the way it did not bound with a line.
Buoy may be laid within the distance of 25 m from the bank in all directions in order not to limit the other fishermen and if it is not said otherwise the inner third of water area should stay free for navigation
